Terms of Service

Welcome to Canpute. These Terms of Service ("Terms") govern your access to and use of the Canpute platform, including the dashboard at dashboard.canpute.ca, our APIs, container registry, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "Canpute," "we," "us," or "our" refers to the Canpute platform and its operators.
- "User," "you," or "your" refers to any individual or entity that accesses or uses the Service.
- "Content" refers to container images, application code, configuration data, and any other materials you upload, deploy, or store through the Service.
- "Cluster" refers to a logical grouping of resources mapped to a Kubernetes namespace within the Service.
- "Workload" refers to any container deployment, service, or task you create and run through the Service.
2. Account Registration
To use the Service, you must create an account by authenticating through a supported provider (GitHub, Google, or Microsoft) or by using email and password. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or use.
3. Use of the Service
Canpute provides a container orchestration platform that allows you to deploy, scale, and manage containerized workloads. The Service includes Express Deploy, auto-scaling, an integrated container registry, custom domain support, team management, and real-time monitoring.
You agree to use the Service only for lawful purposes and in accordance with these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Deploy workloads that violate any applicable law or regulation.
- Host, distribute, or facilitate malware, phishing, botnets, or any form of malicious software.
- Perform cryptocurrency mining or other resource-intensive activities that degrade Service performance for other users.
- Attempt to gain unauthorized access to other users' clusters, workloads, or data.
- Send unsolicited bulk communications (spam) or engage in network abuse from deployed workloads.
- Circumvent or attempt to circumvent resource limits, rate limits, or other Service restrictions.
- Deploy content that infringes on the intellectual property rights of others.
We reserve the right to suspend or terminate workloads and accounts that violate this policy, with or without prior notice.
5. API Usage
The Service provides a RESTful API for programmatic access. All API usage is subject to rate limits and authentication requirements. You must not share your API tokens or Bearer credentials with unauthorized parties. We may revoke API access if we detect abuse or violation of these Terms.
6. Your Content and Data
You retain ownership of all Content you upload, deploy, or store through the Service. By using the Service, you grant Canpute a limited license to host, store, and transmit your Content solely as necessary to provide and operate the Service.
You are solely responsible for your Content, including ensuring that it does not violate any laws or third-party rights. We do not monitor the contents of your container images or workloads, but we reserve the right to remove Content that violates these Terms.
7. Organizations and Team Management
The Service supports organization-based multi-tenancy with role-based access control. If you create or administer an organization, you are responsible for managing member access and permissions. You are liable for the actions of users within your organization to the extent permitted by law.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We may perform scheduled maintenance, during which parts of the Service may be temporarily unavailable.
We are not liable for any downtime, data loss, or service interruptions, whether planned or unplanned.
9. Resource Limits and Scaling
The Service provides auto-scaling capabilities, including horizontal pod auto-scaling with configurable minimum and maximum replicas. Resource consumption is subject to the limits of your account or plan. We reserve the right to impose or adjust resource limits at any time to ensure fair use and platform stability.
10. Intellectual Property
The Service, including its design, features, documentation, and underlying technology, is owned by Canpute and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
Canpute's source code is available at git.galactica.host/canpute/canpute-ecs and is governed by its own license terms, separate from these Terms of Service.
11. Limitation of Liability
To the maximum extent permitted by law, Canpute and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid to Canpute in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Canpute and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your Content, your violation of these Terms, or your violation of any third-party rights.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at our discretion, including if we reasonably believe you have violated these Terms.
Upon termination, your right to use the Service ceases immediately. We may delete your Content, container images, and workload data after a reasonable period following termination. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Canpute operates, without regard to conflict of law principles.
